1. General Provisions
This AML/KYC Policy regulates the user verification procedure for the Bitality.cc service. By using the Service, the User agrees to undergo identity verification.
The Service reserves the right to request any information necessary to verify the User’s identity, as well as to conduct checks independently or through third parties.
The SumSub service is used to perform KYC verification procedures.
The User also agrees to AML screening of all transactions related to the use of the Service.
2. Verification and Involvement of Third Parties
The Service reserves the right to:
- conduct identity and transaction checks;
- engage third-party KYC/AML service providers;
- conduct additional investigations when necessary.
The User consents to such checks and does not restrict the Service in the choice of tools or partners.
3. Grounds for Conducting KYC
The Service may request mandatory identity verification if the source of funds is associated with elevated risk, including:
Illegal Service, Mixing Service, Fraudulent Exchange, Darknet Marketplace/Service, Ransom, Scam, Stolen Coins, Terrorism Financing, Sanctions, Illicit Actors, High-Risk Jurisdiction, Gambling, Fraud Shop, Enforcement Action, Child Exploitation.
4. AML Transaction Analysis
Transaction analysis is performed using systems such as BitOK and CoinKyt.
Each transaction is assigned a Risk Score. If the acceptable risk threshold is exceeded, the transaction may be suspended for additional verification (KYC/SoF).
Risk thresholds:
High Risk — up to 5%
Medium Risk — up to 20%
Overall Risk Score — up to 50%
5. Verification Procedure (KYC)
To complete verification, the User must provide:
Identity Document
Passport, ID card, or driver’s license (photo/scan of the document).
Selfie / Liveness Check
A real-time photo or video of the User’s face via SumSub.
Proof of Address
A document issued within the last 3 months (utility bill, bank statement, invoice, etc.) containing the User’s full name and address.
Source of Funds (SoF)
If required: screenshots, transaction history, proof of income, contracts, and other supporting documents.
6. Refunds
After successful verification, refunds are issued to the sender’s address with deduction of the network fee.
If the User refuses to complete KYC verification, the User must notify the Service via email.
In such cases, the refund will be processed with a 5% deduction (not exceeding $100).
If funds are frozen by third parties, refunds can only be processed after such funds are released.
7. Verification Timeframes
AML/KYC verification procedures may take from 1 to 3 business days depending on the level of risk and the completeness of the provided information.
8. User Obligations
The User agrees to comply with the laws of their country of residence and citizenship, as well as regulations governing financial transactions conducted online.
