RULES FOR THE PROVISION OF SERVICES FOR THE PROVISION OF ACCESS TO THE BITALITY SERVICE
Before using the services of the Bitality service, the User is obliged to familiarize himself in full with the Terms and Conditions of the BITALITY service. The use of the BITALITY service is possible only if the User accepts all the terms of the agreement. It is important for us that you familiarize yourself with the rules established by our Bitality service
1. 1. TERMS AND CONDITIONS
1.1. These Terms of Use define the relationship and regulate the mutual rights and obligations between the client performing an exchange (hereinafter referred to as the “User”) and the Bitality web service (hereinafter referred to as the “Service”).
1.2. The User may use the services of Bitality only if the User accepts the rules and conditions of this Agreement.
1.3. Only after confirming that they have read and accepted these Terms does the User have the right to use the Service.
1.4. Bitality is a trademark of an online electronic currency exchange service system specially designed for our clients.
1.5. User — an individual using the current services of the Service in accordance with the conditions offered by the Service.
1.6. Payment System — a set of rules and procedures ensuring the transfer of funds in electronic form.
1.7. Payment/Transaction — the transfer of electronic currency from the payer to the recipient and vice versa.
1.8. Order — electronic information submitted by the User expressing the intention to use the services under the conditions offered by the Service.
1.9. Service Services — deposit and withdrawal of electronic currency and other services, information about which is published on the Service website.
2. 2. PROCEDURE FOR ACCESSING THE SERVICE
2.1. To gain access to the Service, the User must submit an order on the contractor’s website at: https://bitality.cc/
2.2. Through the user interface located on the Service website, the User may manage the exchange process or obtain information about the status of the ordered service.
2.3. Bitality processes Orders in accordance with the operating conditions of Partner Payment Systems. The Service is not responsible for the operation of any other Payment System.
2.4. The Service verifies the legality of the User’s ownership of the electronic currencies and/or funds involved in a particular transaction.
2.5. The User undertakes to transfer the amount specified in the Order, while Bitality undertakes to transfer the received funds to the User according to the exchange rate and commission.
2.6. The Service fee for the provided services is displayed in each Order as part of the exchange rate, and the User agrees to the specified amount by following the instructions during the execution of the Order.
2.7. Once the funds are debited from the Service account within the Payment System, the service of transferring funds to the User shall be considered fully completed. The transaction is recorded in the transaction history of the relevant Payment System and in the Service client interface.
2.8. A User’s withdrawal Order will be canceled if funds are not credited to the Service account within 20 minutes. Upon the User’s request, electronic funds received after the specified time are returned minus commission expenses. Refunds are processed only upon written request within 24 hours.
2.8.1. If the transaction does not appear on the network within 10 minutes from the moment the Order is created, the exchange service reserves the right to recalculate the Order at the moment of crediting to the exchange. (This rule applies to directions where rates are fixed at the moment the Order is created.)
2.8.2. When exchanging one electronic currency for another, the exchange rate is fixed at the moment the coins are fully credited to the exchange. Therefore, recalculation may occur without prior notice to the client. (The required number of confirmations can be viewed during Order creation.)
2.8.3. The Order displays a preliminary exchange rate formed according to the best available market price. If market values change by more than 0.2%, a protection mechanism against potential losses is activated. This mechanism may reduce the final price by up to 1.5% from the current rates on Binance / ByBit / HTX / KuCoin.
2.8.4. For exchanges involving banks and payment systems, the exchange rate is fixed at the moment of Order creation and may be changed without prior notice if the current market rate deviates by more than 0.5% from the original rate specified in the Order.
2.9. Data regarding electronic funds received after the designated time is stored by the Service for 30 business days. After this period, all information is destroyed and refunds are not possible.
2.10. Refunds are not provided if the amount received from the User is below the minimum established amount. The User undertakes to provide correct payment details. If incorrect sender payment details are specified, the Service may request additional information via technical support email for transaction identification.
2.11. If the User provides invalid or blocked details or refuses to complete the transaction, the Service has the right to terminate the transaction and, upon written request by the User, issue a refund minus a 0.5% penalty fee and Payment System commissions. Funds are returned strictly to the original account from which they were received.
2.12. Orders are processed within 15 minutes after the funds are credited to our account. For the Bitcoin network, crediting is considered complete after 3 confirmations.
2.13. If the Service mistakenly transfers an amount exceeding the agreed exchange amount, the User undertakes to return the mistakenly received amount. Otherwise, the Service reserves the right to deduct the difference from future exchanges.
2.14. If funds are not credited to the Service account within 2 hours, the exchange service reserves the right to recalculate the Order amount at the current rate or return the funds to the sender. All return commissions will be deducted from the refund amount.
2.15. The User undertakes to provide all identity verification documents if there is suspicion of fraud or money laundering.
2.16. Upon request, the User must provide additional information confirming the transfer of funds to the Service wallet, including screenshots or videos showing login to the platform from which the transfer was made.
2.17. If payment systems or cryptocurrency exchanges freeze funds received from the User, the Order is suspended until the funds are fully released. The rate will be fixed at the moment the funds are released and after communication with the client. The client must provide all necessary documents for the release of funds.
2.18. The exchange service will only return cross-chain deposits whose value exceeds the equivalent of 100 USD at the time of the transaction. (A cross-chain deposit refers to depositing one cryptocurrency to a wallet address intended for another cryptocurrency or with an incorrect or missing special identifier.)
2.18.1. The refund process may take up to 90 days (counted from the date all requested information is provided).
2.18.2. A fee of 30% of the refund amount will be charged for refund processing actions.
2.18.3. Not all cross-chain deposits are eligible for refund.
2.18.4. The exchange service does not return coins or tokens that are not supported for exchange on the website.
2.18.5. The User must provide screenshots and videos clearly showing the website/application from which the transfer was made and the transaction details in the transaction history.
3. 3. COST OF SERVICES
3.1. The exchange rate is displayed on the Bitality website. Exchange rates are constantly updated.
3.2. The service commission is included in the exchange rate for each exchange direction.
3.3. Rates may be changed by the Service unilaterally without prior notice to the User.
3.4. The Service offers a bonus system for registered users. Information about discounts and bonuses is available in the “Affiliate Program” section on the Bitality website.
4. 4. LIABILITY OF THE PARTIES
4.1. The Service provides services for the exchange, purchase, and sale of electronic money.
4.2. The Service shall provide services to the User 24/7 while ensuring quality and timely technical support.
4.3. The Service guarantees fulfillment of obligations only within the amounts entrusted to the Service by the User for the transaction.
4.4. The Service is not liable for financial losses caused by unlawful actions of third parties.
4.5. The Service bears no responsibility for losses, lost profits, or other expenses resulting from delays, errors, or failures in banking payments or electronic transfers.
4.6. The User must use a valid email address for registration.
4.7. The Parties are released from liability for partial or complete failure to fulfill obligations caused by force majeure circumstances arising after acceptance of the Terms.
4.8. Force majeure circumstances include floods, fires, earthquakes, wars, military actions, acts of state authorities, and any other circumstances beyond reasonable control.
4.9. The User guarantees that they are the owner or have lawful grounds to dispose of the amounts used in transactions.
4.10. If the User provides incorrect recipient details, the Service bears no responsibility for any resulting losses or damages.
4.11. The User undertakes not to violate legal norms, falsify communication flows, or disrupt the normal functioning of the Service software.
4.12. The Service guarantees confidentiality of User information and transactions. Information may only be disclosed to authorized governmental authorities or Payment Systems upon lawful request.
4.13. The Parties communicate via technical support and email.
4.14. The Service is not responsible for the quality of operation of other Payment Systems.
4.15. The User undertakes to provide details of a personal wallet or exchange account. The Service is not responsible for issues arising from transfers to third-party addresses.
5. 5. OTHER MUTUAL AGREEMENTS
5.1. Use of the Service for fraudulent or illegal operations is prohibited.
5.2. The Service administration reserves the right to provide information regarding suspicious payments to law enforcement agencies, Payment Systems, or fraud victims if fraud is proven.
5.3. The Service administration has the absolute right to refuse service to any client without explanation.
5.4. Client and transaction information is stored on the server for 3 months. Upon request, account access may be restricted or deleted.
5.5. The Service may send emails regarding the status of the exchange process as an integral part of successful transaction completion.
5.5.1. The Service may also send information regarding promotions and special offers.
5.5.2. The User may unsubscribe from promotional emails by notifying the Service.
5.6. Disputes are resolved through negotiations based on a written statement sent from the email address specified in the Order.
5.7. The Service administration reserves the right to amend or supplement this Agreement at any time.
5.8. The Service reserves the right to terminate communication with clients behaving improperly or refusing to provide necessary information.
5.9. Referral rewards are not начислено if profit is less than 0.7%. At least 3 successful referrals are required.
5.9.1. Creation and use of multiple accounts for referral rewards is prohibited.
5.9.2. Use of the Bitality logo in paid online advertising is prohibited.
5.9.3. Referral link spamming is prohibited.
5.9.4. Bitality reserves the right to modify referral program conditions without notice.
5.10. Claims related to Order execution must be submitted within 30 calendar days. After this period, claims are not accepted and obligations are considered fulfilled.
6. 6. TAXATION
6.1. The Service is not a tax agent for the User and will not notify the User regarding tax liabilities. The User is solely responsible for paying taxes according to the laws of their country of residence.
6.2. If authorities require the Service to pay User taxes or debts arising from the User’s refusal to pay taxes, the User agrees to reimburse the Service for all such payments.
7. 7. USER VERIFICATION
7.1. By using the Bitality.cc exchange service, the User agrees to undergo identity verification.
7.2. The Service may request any personal data in any format and quantity deemed necessary for full identification.
7.3. The User consents to checks conducted directly or through third parties for identity verification and protection against financial crimes such as fraud.
7.4. By undergoing verification, the User consents to any investigations deemed necessary by the Service.
7.5. The User agrees to AML checks of all transactions conducted through the Service.

7.5.2. The Service uses specialized AML blockchain analysis systems including BitOK and CoinKyt.
7.5.3. Transactions are assigned a Risk Score. If the threshold is exceeded, the exchange operation may be suspended for additional KYC/SoF checks.
7.5.4. Risk guidelines:
High Risk assets — up to 5%
Medium Risk assets — up to 20%
Overall Risk Score — must not exceed 50%
If these limits are exceeded, the transaction may be suspended for additional verification.
After successful KYC verification, refunds are sent to the sender’s address minus network fees.
If the client refuses KYC verification, they must notify the Service via email, specifying the Order number and refund details. Refunds will then be issued minus a 5% service fee (not exceeding $100).
If funds are frozen by exchanges or payment systems due to AML risks, refunds may only be processed after full release of the funds.
7.5.5. AML/KYC procedures may take from 1 to 3 business days depending on the risk level and completeness of the information provided.
7.6. The User undertakes to comply with all applicable laws and regulations governing online financial transactions in their country of residence and citizenship.
